1. Introduction

These Terms of Service ("Terms") govern the access and use of the Omniflow platform, website, and integrated Meta API services (the "Service") provided by Avenir IT (Pvt) LTD ("we," "us," or "our"). By registering an account or connecting a Meta Business asset (WhatsApp, Facebook, or Instagram) to our platform, the Business User ("Client," "you") agrees to be bound by these Terms.

2. Scope of Service

Omniflow provides a communication and lead management interface that allows Business Users to:

  • Interact with customers via automated chatbots and human agents.
  • Manage multimedia files (PDFs, Images) and location data.
  • Organize leads, appointments, and service follow-ups.
  • Manage financial details of leads and proposals.

3. Compliance with Meta Platforms

Omniflow integrates with Meta APIs. By using this Service, you also agree to comply with:

  • Meta Business Terms
  • WhatsApp Business Policy
  • Facebook Platform Terms

Any violation of Meta's policies that results in the suspension of your Meta account is the sole responsibility of the Client.

4. Client Responsibilities & Acceptable Use

The Client agrees not to use the Service to:

  • Send "spam" or unsolicited marketing messages in violation of Meta's policies.
  • Upload content that is illegal, defamatory, or violates intellectual property rights.
  • Misrepresent their identity or the nature of their business.
  • Share sensitive medical data without proper patient consent.

5. Data Processing & Ownership

Ownership: The Client retains all ownership rights to the data (messages, files, customer info) transmitted through the platform.

License: You grant Omniflow a limited license to host and process this data as necessary to support the platform's features, including automated messaging and lead management.

Product Improvement: Omniflow may use anonymized, de-identified, and aggregated data to train machine learning models and enhance chatbot algorithms. This process is strictly designed to ensure no individual person, patient, or Client can be identified.

Security: We implement TLS encryption and secure storage protocols. However, the Client is responsible for managing the access levels granted to their own employees/agents within the App.

6. Fees and Payment

Subscription: Omniflow Services are provided based on the user creation limitation subscription plan. According to the usage, we limit user creation (agents). There are no quotas or caps on message volume; authorized agents may send unlimited messages, subject only to third-party fees (such as Meta's conversation-based charges).

Meta Charges: The Client is responsible for any per-message charges or fees levied directly by Meta for the use of the WhatsApp Business API. Additionally, the Client is liable for all costs associated with other integrated platforms, such as SMS gateway charges or third-party service fees.

7. Limitation of Liability

To the maximum extent permitted by law:

  • Omniflow shall not be liable for any indirect, incidental, or consequential damages.
  • We are not responsible for service interruptions caused by Meta Platforms, internet service providers, or hardware failures.

Indemnification: The Client agrees to indemnify Omniflow against any claims arising from the Client's misuse of the platform or breach of patient confidentiality.

8. Access Control

By Client: You can inactivate your account at any time via the Omniflow app.

By Omniflow: We reserve the right to suspend or terminate access if these Terms are violated or if required by Meta Platforms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

User Data Deletion - Data Deletion Instructions

Omniflow is committed to protecting your privacy and providing you with control over your personal information. In compliance with Meta's Platform Terms, we provide a clear process for users to request the deletion of their data from our systems.

How to Request Data Deletion

If you have interacted with a business or service provider via Omniflow on Facebook, Instagram, or WhatsApp, you may request the removal of your data through the following steps:

Step 1: Remove the App from Meta Platforms

To stop Omniflow from accessing your Meta profile information in the future:

  • Log in to your Facebook account.
  • Navigate to Settings & Privacy > Settings.
  • Select Apps and Websites from the left-hand menu.
  • Locate Omniflow and click the Remove button.

Step 2: Request Permanent Deletion from Omniflow App Storage

Removing the app from Facebook does not automatically delete the historical chat logs or files (PDFs, Images) stored within the business's Omniflow App dashboard. To request permanent deletion of these records:

  • Send an email to our Data Privacy Team at contact@omniflowcrm.com
  • Verification Requirement: To protect your data, your identity must be verified. Please send the request using the email address associated with your account or the one provided during your interaction with the Omniflow App. *Subject Line: "Data Deletion Request - [Your Name/Phone Number]".
  • Email Body: Please specify the Business or Service you were communicating with.
  • Processing Time: Once your identity is verified via your registered email, our team will purge your records from our database within 7 business days.
